These terms are the agreement between Bilt Base ("we", "us") and the company that opens an account ("you", "your company"). By creating an account or using the service you accept them on your company's behalf.
Bilt Base is construction management software: leads, site visits, estimates, proposals, projects, work orders, purchasing, change orders, invoicing, job costing, and the mobile applications that go with them. We provide it as a subscription, host it, maintain it, and back it up.
Your company's administrators control who has access and what each person can do. You are responsible for the accuracy of what your people enter and for keeping credentials confidential. Accounts are for people; sharing one login between people defeats the audit trail that protects you, and we may require it to stop.
Everything your company enters remains your company's property - projects, clients, photographs, documents, all of it. We claim no ownership and no license beyond what is needed to operate the service (storing, displaying, backing up, and transmitting it at your direction, such as emailing a proposal to your client). You can export your data in standard formats at any time, including after you decide to leave.
Do not use the service to break the law, to store content you have no right to store, to probe or disrupt the service or other companies' accounts, or to resell access. Each company's data is isolated; attempting to cross that boundary ends the agreement immediately.
Fees, billing cadence, and any implementation charges are stated in your order or proposal. Fees are not contingent on usage volume unless your order says otherwise. We will give at least 30 days' notice before any price change, effective at your next renewal.
We aim to keep the service continuously available and we monitor it, but we do not promise uninterrupted operation. We may improve or change features; we will not materially reduce the service you are paying for during a paid term without your agreement. Support terms and response targets are stated in your order.
Our Privacy Policy describes what we collect and how it is handled; it is part of these terms. We maintain daily backups, encryption in transit, encryption at rest for stored credentials, per-company isolation, and audit records of changes.
AI analysis is off by default and runs only when your company enables it with its own API key. AI-generated content is labelled as such and is advisory: a person remains responsible for decisions made from it.
The service is provided "as is". We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Bilt Base is a record-keeping and workflow tool: it is not engineering, accounting, tax, or legal advice, and your company remains responsible for its own estimates, contracts, filings and compliance.
To the maximum extent the law allows, neither party is liable for indirect, incidental, or consequential damages, and our total liability arising from the service is limited to the fees your company paid in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
Either party may end the agreement at the end of the current paid term with notice. We may suspend or end access immediately for material breach of section 4. When the agreement ends, your company has 30 days to export its data, after which we delete it as described in the Privacy Policy. We will never hold your data hostage to a dispute.
These terms are governed by the laws of the Commonwealth of Pennsylvania, excluding its conflict-of-law rules. If any part is unenforceable, the rest stands. These terms plus your order are the whole agreement and replace prior discussions. Questions: legal@biltbase.com.
